Service.

Acceptance.

By installing, accessing, or using the Service, you acknowledge that you have read these Terms and agree to be bound by them. If you do not accept these Terms in full, you must discontinue use of the Service.

We may revise these Terms from time to time. The effective date at the top of this document reflects the current version. Continued use of the Service after revisions are published constitutes your acceptance of the revised Terms.

The Service.

WizCraft is a software application that enables users to generate AI-produced images and short video from text, photos, and other inputs. We host the underlying models, perform the inference, and deliver the generated output through the application.

We reserve the right to add, modify, suspend, or discontinue features of the Service at any time, with or without notice.

Privacy.

Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you acknowledge that you have reviewed and accept the Privacy Policy.

Credits and payment.

Use of generative features requires credits. Credits are purchased through the in-app store of the platform on which you use the Service (such as the Apple App Store or Google Play). The platform store processes the transaction, issues the receipt, and determines the applicable refund policy. Refunds are governed by the policies of the relevant platform store; we do not process refunds independently.

Credits are associated with the account through which they were purchased and are non-transferable. Restoration of prior purchases follows the standard procedure of the relevant platform. Promotional credits, gifts, and trial balances may be subject to expiration and to additional terms disclosed at the time of the offer.

Intellectual property.

The Service — including its source code, user interfaces, trademarks, models, and visual design — is owned by WizCraft or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You may not copy, mirror, modify, decompile, reverse engineer, repackage, or use the Service to develop a competing product, except where expressly permitted by applicable law or by written agreement with us. Nothing in these Terms transfers ownership of the Service, its trademarks, or any underlying technology to you.

User content.

You retain ownership of the prompts you submit, the source materials you upload, and the outputs you generate through the Service, to the extent such materials are eligible for ownership under applicable law.

You grant WizCraft a worldwide, royalty-free, non-exclusive license to host, store, process, display, and — where you elect to share content — distribute your user content solely as necessary to operate, secure, and improve the Service. This license terminates when the content is removed from the Service.

Disclaimer of warranties.

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. Generated content may be inaccurate, unexpected, or unsuitable for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or that any specific result will be obtained.

To the maximum extent permitted by applicable law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. You assume sole responsibility for determining whether the Service and its outputs are suitable for your intended use.

Account security.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must promptly notify us of any unauthorized access or suspected breach.

We shall not be liable for any loss resulting from compromised credentials that were within your control to secure.

Third-party services.

The Service may include links to, or integrations with, services operated by third parties — such as payment processors, authentication providers, and hosting providers. These services are governed by their own terms and privacy policies. We do not control and are not responsible for the availability, content, or practices of any third-party service.

Limitation of liability.

To the maximum extent permitted by applicable law, WizCraft and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including loss of data, profits, revenue, or goodwill — arising out of or relating to your use of the Service.

Our aggregate liability for any and all claims arising out of or relating to these Terms or the Service shall not exceed the total amount you paid to us during the three (3) months immediately preceding the event giving rise to the claim.

Termination and governing law.

Termination — You may discontinue use of the Service at any time. We may suspend or terminate your access to the Service if you breach these Terms or if continuation becomes impractical. Provisions intended to survive termination — including those relating to intellectual property, disclaimers, and limitation of liability — shall remain in effect.

Governing law — These Terms shall be governed by the laws applicable in the jurisdiction in which the Service is offered, without regard to its conflict-of-law principles. If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.

Amendments — We may amend these Terms from time to time. Material changes will be reflected by an update to the effective date above. Your continued use of the Service following such changes constitutes acceptance of the amended Terms.
